Who we are
Team John Garuti - EXP Realty ("we," "us") owns and operates newbuildscapecoral.com ("New Builds Cape Coral"), a home-search website focused on new-construction real estate in Cape Coral, Florida. This policy explains what information we collect, how we use it, and the choices you have.
It covers this site only — not the builder websites, the MLS, or the map and analytics providers we link to, each of which has its own policy.
Information we collect
- Information you give us — your name, email address, and phone number when you create an account, save homes, set up listing alerts, request a tour, unsubscribe, suggest a feature, or contact an agent; plus any message you include.
- Usage information — pages viewed, searches performed, and saved homes, which we use to operate features like favorites and alerts. This includes the notes and tags you add to a saved home, your saved searches, and your alert preferences.
- Technical information — IP address, browser type, and cookies necessary for signing you in and keeping the site working, together with the referring page recorded in our server logs and, only if you accept cookies, analytics.
- Tour and inquiry details — the home you asked about, your preferred days and times, and any message you write.
- Verification data — the one-time code we text to confirm a mobile number is yours, and the time it was confirmed.
How we use it
- To operate your account: saved homes, saved searches, and listing alerts you request, kept in sync across your devices along with your favorites and notes.
- To respond to tour requests and agent inquiries — when you submit one, your contact information and message are shared with our team and the appropriate licensed real-estate professionals, including the builder or listing agent for the home you asked about, so they can respond.
- To send you emails you've opted into — listing alerts for new listings, price drops and status changes, plus market updates — at the cadence you choose. Every email includes an unsubscribe link.
- To send SMS messages only with your express consent, as described at the point of collection. Reply STOP to opt out at any time.
- To see how the site is used so we can improve it, and to measure whether our advertising works.
- To meet Florida real estate licensing and record-keeping obligations.
What we don't do
- We do not sell your personal information, and we never have.
- We do not share your contact information with third parties except as needed to respond to your specific request (e.g., connecting you with an agent), to comply with law, or with service providers who process data on our behalf (e.g., email and SMS delivery).
- Your mobile number and your consent to receive texts stay with us — we do not sell it or share it with third parties for their marketing.
- We do not send marketing text messages without your express written consent.
- We do not use your information for anything unrelated to helping you find and buy a new-construction home in Cape Coral.
SMS / text message data
When you provide your mobile phone number and check the consent box, you opt in to the Team John Garuti - EXP Realty SMS text-messaging program and agree to receive SMS messages and/or phone calls from Team John Garuti - EXP Realty about your inquiry, tour requests, listing and price alerts you set up, account and verification messages, and related real-estate updates. In connection with the program we collect your mobile number, the date, time, and exact wording of the consent you agreed to, and message delivery status.
We do not sell your mobile information, and we do not share your mobile number or SMS opt-in data with third parties or affiliates for their own marketing or promotional purposes. Your number is shared only with our SMS delivery provider (e.g., Twilio) solely to transmit the messages you requested, and as required by law. Message and data rates may apply, and message frequency varies. Reply STOP to any SMS to stop text messages, or reply HELP for help, at any time. Consent to receive texts is not a condition of any purchase. Full program terms, including frequency and support contacts, are in our Terms of Service.
Cookies & sign-in
We use a session cookie to keep you signed in and basic analytics to understand how the site is used. We do not use cross-site advertising trackers.
The sign-in cookie is app_session_id. It is strictly necessary, HTTP-only, cannot be read by scripts, and lasts up to a year or until you sign out. Analytics and advertising cookies (Google Analytics and the Meta Pixel) load only after you accept them in the cookie banner; your choice is stored in your browser and you can change it by clearing site data. Signing in with Google shares your name and email address with us and nothing else; a magic-link sign-in shares only your email address.
Your choices
- Unsubscribe from email at any time via the link in any message or at newbuildscapecoral.com/unsubscribe.
- Reply STOP to any SMS to stop text messages.
- To access, correct or delete your information, email us at [email protected]. We answer within 30 days and may need to verify it is you.
- Decline analytics cookies in the banner. The site works exactly the same either way.
MLS / listing data
Listing information is provided by the MLS for consumer, non-commercial use and is subject to the disclaimer shown in our footer. Listing data is not personal information about you, and it is governed by the MLS's own terms rather than this policy.
